It's probably not in your best interest if you take your spouse off of your insurance after you filed for divorce. This is primarily because once that divorce has been filed within the state of Texas, there's going to be some type of order, such as a temporary order or even a temporary restraining order, so it prohibits you from taking action in removing your spouse from your insurance plan. It's a much smarter idea to wait until after the divorce has been finalized and then, of course, once that divorce has been finalized it will constitute a qualifying event and you'll have the opportunity at that point to remove your spouse from your insurance plan or to be put on a new insurance plan after the divorce has been finalized.
