Is temporary spousal support available in Texas during a divorce?
So temporary support is available during divorces. In Texas, there are certain requirements that you have to meet in order to qualify for temporary support. But generally speaking, if one spouse is the breadwinner and the other spouse, isn't the court's going to want to make sure that both spouses have enough income in order to meet their minimum reasonable needs to cover things such as their rent, their groceries, their general living expenses. Judges want to make sure that the community income coming into a household is distributed in such a manner that both spouses are able to take care of all of their living expenses. There are certain caps that the judges look at and can put on temporary spousal support because they want to make sure that all of the bills are being covered so we can look at each party's individual circumstances, the income that they need to cover those expenses and determine what's an appropriate amount to ask for from the community income.
